These Terms of Service (“Terms”) govern your access to and use of the Belmont Watches website, located at www.belmontwatches.com, including any content, features, products, and services made available through the website (collectively, the “Website”).

Throughout these Terms, “Belmont Watches,” “we,” “us,” and “our” refer to Belmont Watches. “You” and “your” refer to the person accessing the Website or purchasing, selling, trading, consigning, or submitting a product for service through Belmont Watches.

By visiting the Website, creating an account, submitting information, or purchasing a product from us, you agree to be bound by these Terms and our Privacy Policy, Refund Policy, Warranty Policy, and any additional terms presented in connection with a particular product or service.

If you do not agree to these Terms, you may not access or use the Website.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to make a purchase, sell or consign an item, submit an item for service, or otherwise conduct a transaction through Belmont Watches.

By using the Website, you represent that the information you provide is accurate, current, and complete and that you are authorized to use any payment method or account information submitted to us.

We reserve the right to refuse service, cancel an order, limit quantities, or terminate access to the Website when reasonably necessary to protect Belmont Watches, our customers, or third parties.

2. Products and Services

Belmont Watches buys, sells, trades, consigns, services, and authenticates watches, jewelry, straps, accessories, and related products. Our inventory may include:

  • New products sold as an authorized dealer;

  • Pre-owned, previously worn, or previously serviced products;

  • Vintage and antique products;

  • Limited-edition and discontinued products;

  • Jewelry, straps, accessories, packaging, and replacement components; and

  • Products offered on consignment by third-party owners.

Products described as “new,” “pre-owned,” “vintage,” “unworn,” “serviced,” or with similar terminology will be classified according to our reasonable professional assessment and the information available to us at the time of listing.

Because many of our products are unique or available in limited quantities, availability is not guaranteed until we accept and confirm your order.

3. Pre-Owned and Vintage Products

Pre-owned and vintage watches and jewelry may display signs of age, previous use, polishing, repair, restoration, or component replacement. These characteristics may include scratches, marks, patina, fading, bracelet stretch, refinishing, replacement parts, service parts, or other condition-related variations.

We make reasonable efforts to describe material condition issues and known component variations. However, normal signs of wear and age may not always be individually identified.

Unless expressly stated in the product listing:

  • A product is not represented as being in factory-new condition;

  • Water resistance is not guaranteed;

  • Timekeeping performance may vary from modern factory specifications;

  • Vintage products should not be exposed to water, moisture, shock, magnets, or extreme temperatures;

  • Boxes, papers, tags, manuals, accessories, service records, and warranty cards are included only when specifically listed; and

  • A product’s previous service, polishing, repair, or ownership history may be incomplete or unknown.

Customers are encouraged to review all photographs and descriptions and contact us with questions before purchasing.

4. Authenticity and Product Information

Belmont Watches professionally evaluates the products it offers for sale and represents products as authentic based on the inspection, research, documentation, and information reasonably available to us.

Descriptions of originality, production date, model, reference number, serial range, dial, movement, case, bracelet, accessories, service history, and provenance reflect our professional assessment at the time of listing. Certain vintage or pre-owned products may contain manufacturer service components, period-correct components, restored components, or replacement parts.

Any known material component variations will be disclosed when reasonably identifiable. Unless expressly stated otherwise, a representation that a watch is authentic does not necessarily mean every individual component is original to the watch when it first left the manufacturer.

Manufacturer names, model names, trademarks, and logos belong to their respective owners. Unless expressly identified as an authorized dealer relationship, reference to a manufacturer does not imply sponsorship, affiliation, authorization, or endorsement.

5. Photographs and Display

We make reasonable efforts to display product photographs, colors, finishes, dimensions, and condition accurately. However, appearance may vary due to lighting, photography, screen settings, image processing, monitor calibration, and other factors.

Unless a listing clearly indicates that stock or representative images are being used, photographs of pre-owned and vintage products are generally intended to depict the actual item offered for sale.

Images may be enlarged to show condition and details. Customers should review the listed measurements rather than relying on photographic scale.

6. Prices and Corrections

All prices displayed in United States dollars are subject to change without notice.

We reserve the right to correct typographical errors, inaccurate descriptions, incorrect prices, availability errors, technical errors, or other mistakes at any time, including after an order has been submitted.

If an item is listed at an incorrect price or with materially incorrect information, we may cancel the order and refund any payment collected. We are not obligated to honor an order resulting from an obvious pricing, inventory, or listing error.

Discounts, promotional offers, trade allowances, and coupon codes may be limited, modified, or discontinued at any time and may not be combined unless expressly stated.

7. Orders and Acceptance

Submitting an order does not guarantee acceptance. Your order is an offer to purchase the selected product under these Terms.

An automated order confirmation acknowledges that we received your order but does not necessarily constitute final acceptance. We may review and verify an order before accepting it.

We may decline, hold, or cancel an order for reasons including:

  • Product unavailability;

  • A pricing or listing error;

  • Suspected fraud or unauthorized activity;

  • Inability to verify identity, payment, billing, or shipping information;

  • A payment authorization failure;

  • A high-risk or restricted shipping destination;

  • A request to ship contrary to our security procedures;

  • A suspected reseller or prohibited commercial transaction; or

  • Any other lawful business or security reason.

If we cancel an order after receiving payment, we will issue a refund to the original payment method, unless another lawful arrangement is agreed upon.

8. Identity and Transaction Verification

Luxury watches and jewelry are high-value products. To prevent fraud and protect customers, we may require additional verification before completing a transaction.

Verification may include requesting government-issued identification, confirming billing information, verifying a shipping address, obtaining payment authorization, confirming a telephone number, requesting a signature, or asking the purchaser to complete another reasonable security procedure.

Failure to complete requested verification may result in delayed shipment or cancellation.

We may require that an order be shipped only to a verified billing address or held for pickup. We may also require an adult signature upon delivery.

9. Payments

You agree to provide accurate and authorized payment information and to pay all charges associated with your order.

Payment methods may be processed by third-party payment providers. We do not directly control those providers’ approval processes, security procedures, holds, processing times, or account restrictions.

Bank transfers and other irreversible payment methods must be initiated only using payment instructions provided directly by Belmont Watches through a verified communication channel. Customers should independently confirm payment instructions before sending funds.

Belmont Watches is not responsible for payments sent to fraudulent accounts or individuals impersonating Belmont Watches when the payment instructions were not provided or verified by us.

10. Taxes, Duties, and International Orders

Applicable sales tax will be calculated and collected as required by law.

International customers are responsible for determining and paying all customs duties, import taxes, brokerage charges, value-added taxes, and other governmental fees imposed by the destination country, unless expressly stated otherwise.

Customs delays are outside our control. We are not responsible for delays, seizures, rejections, or additional charges caused by customs authorities or a customer’s failure to comply with applicable import requirements.

Customers may not refuse a shipment solely to avoid customs duties or import charges. Any refund for a refused international shipment may be reduced by shipping expenses, return expenses, customs charges, insurance expenses, and other costs incurred by Belmont Watches, to the extent permitted by law.

11. Shipping and Delivery

Shipping dates and delivery estimates are estimates unless expressly guaranteed in writing.

We will make reasonable efforts to ship within the timeframe stated at checkout or in the product listing. If no shipping timeframe is stated, we will ship within the timeframe required by applicable law.

If we cannot ship within the stated or legally required timeframe, we may contact you with an updated estimate and provide any cancellation or refund options required by law.

Orders may require insurance, tracking, identity verification, and an adult signature. You are responsible for providing a secure and accurate delivery address.

You must notify us promptly if:

  • Tracking shows delivery but the package cannot be located;

  • A package appears damaged or tampered with;

  • The package contains an incorrect product;

  • An item is missing; or

  • The shipment otherwise appears compromised.

You should retain all packaging, labels, photographs, surveillance footage, and supporting documentation while a shipping claim is investigated.

Once a carrier confirms delivery to the address provided at checkout, responsibility for securing the package generally passes to the recipient, except where applicable law provides otherwise. We may assist with a carrier or insurance claim, but assistance does not guarantee that a claim will be approved.

12. In-Store Pickup

Orders designated for in-store pickup may be released only after payment, identity, and transaction verification are complete.

The person collecting the item may be required to present government-issued identification and the payment card used for the transaction. We may refuse to release a product to an unauthorized third party.

Risk of loss generally transfers to the purchaser when the item is physically delivered to and accepted by the purchaser or authorized recipient, subject to applicable law.

13. Returns and Refunds

Returns and refunds are governed by the Belmont Watches Refund Policy in effect at the time of purchase, which is incorporated into these Terms by reference.

As of the Last Updated date above, eligible return requests generally must be submitted within seven days after receipt. Products must satisfy all requirements stated in the Refund Policy, including condition, packaging, tag, documentation, and authorization requirements.

Items returned without prior authorization may be refused.

Certain products may be final sale or ineligible for return, including products identified as final sale, personalized or custom products, special orders, altered or sized products, products damaged after delivery, and other excluded products described in the Refund Policy or product listing.

The removal, alteration, or damage of a security tag may make a product ineligible for return.

Refunds are issued only after the returned product has been received and inspected. Belmont Watches may deny a return or deduct an amount for damage, wear, missing accessories, alteration, misuse, or a material change in condition, to the extent permitted by law.

Original shipping, insurance, payment processing, financing, international duties, and return shipping charges may be nonrefundable when stated in the Refund Policy or permitted by law.

If a product listing or written sales agreement contains return terms specific to that transaction, those specific terms will control over the general Refund Policy.

14. Warranties

Warranty coverage varies by product.

New products purchased through an authorized dealer relationship may be covered by the applicable manufacturer’s warranty. Manufacturer warranties are administered according to the manufacturer’s terms and eligibility requirements.

Qualifying pre-owned products that were serviced through Belmont Watches may be covered by a remaining original manufacturer warranty or the Belmont Watches One-Year Limited Warranty, unless otherwise stated.

Vintage watches, antique watches, jewelry, accessories, straps, and products specifically sold without warranty may be excluded from Belmont Watches warranty coverage.

Warranty coverage, exclusions, claim procedures, service times, and available remedies are governed by the Belmont Watches Warranty Policy and any written warranty supplied with the product. Those documents are incorporated into these Terms by reference.

No employee, contractor, or representative may modify a written warranty unless the modification is provided in writing by an authorized representative of Belmont Watches.

Nothing in these Terms limits any warranty or consumer right that cannot lawfully be waived.

15. Watch Accuracy, Water Resistance, and Use

Mechanical watches are precision instruments that may gain or lose time. Accuracy may be affected by age, movement type, service history, position, temperature, magnetism, activity, shock, and wearing habits.

Unless expressly stated in writing, Belmont Watches does not guarantee that a pre-owned or vintage watch will operate within its original manufacturer accuracy specification.

Water-resistance ratings describe laboratory test conditions and do not guarantee permanent protection against water intrusion. Gaskets, seals, crowns, pushers, crystals, and cases may deteriorate over time.

Unless Belmont Watches has provided a recent written pressure-test result and expressly represented the watch as suitable for water exposure, customers should not expose a pre-owned or vintage watch to water.

Water resistance should be tested regularly by a qualified watchmaker. Damage caused by water, moisture, improper crown use, operating pushers underwater, impact, misuse, or failure to maintain seals may not be covered by warranty.

16. Selling, Trading, and Consigning Products

Website estimates, preliminary offers, and valuation ranges are not binding unless confirmed in a written agreement after physical inspection.

Any offer to purchase or trade a product may be revised or withdrawn if our inspection reveals differences involving authenticity, condition, ownership, service history, accessories, marketability, legal status, or other relevant factors.

By submitting an item for sale, trade, or consignment, you represent and warrant that:

  • You are the lawful owner or are authorized by the lawful owner;

  • The item is not stolen, counterfeit, subject to a lien, or involved in a dispute;

  • The information you provide is accurate and complete;

  • You have disclosed known modifications, repairs, replacement parts, and material defects; and

  • The transaction does not violate any law, court order, contract, or third-party right.

Consignment transactions are governed by a separate consignment agreement. If these Terms conflict with a signed consignment agreement, the signed consignment agreement controls for that transaction.

17. Service, Repair, and Authentication

Service, repair, restoration, appraisal, and authentication requests may be governed by separate estimates, authorizations, intake documents, or service terms.

Estimates may change after a product is opened, inspected, tested, or evaluated. We will request authorization before performing materially additional paid work unless otherwise agreed.

Watch service may require replacement of worn or damaged components. Replacement parts may differ cosmetically from original or vintage components.

Authentication opinions are based on the item’s condition, components, information, and technology available at the time of inspection. An authentication opinion is not an appraisal of value, ownership, provenance, or future marketability unless expressly stated.

18. No Investment Advice or Guaranteed Value

Watches, jewelry, and collectibles may increase or decrease in value. Past prices, scarcity, popularity, auction results, or market performance do not guarantee future value.

Website content, product descriptions, articles, social-media posts, opinions, and communications are provided for general informational and commercial purposes. They do not constitute investment, financial, tax, or legal advice.

You are solely responsible for evaluating whether a purchase is appropriate for your personal use, collection, or financial circumstances.

19. Accounts and Account Security

You may be able to create an account through the Website. You are responsible for maintaining the confidentiality of your login credentials and for activity conducted through your account.

You must notify us promptly if you believe an account has been accessed without authorization.

We may suspend or terminate an account that is used fraudulently, unlawfully, abusively, or in violation of these Terms.

20. Intellectual Property

The Website and its content—including text, photographs, graphics, videos, logos, page designs, product descriptions, articles, databases, and software—are owned by Belmont Watches, licensed to Belmont Watches, or used with permission and are protected by applicable intellectual-property laws.

You may access the Website for personal, noncommercial use. You may not, without prior written permission:

  • Copy, reproduce, republish, distribute, sell, or exploit Website content;

  • Use our photographs or descriptions to advertise another product;

  • Scrape, harvest, index, or extract Website data through automated means;

  • Remove copyright, trademark, or ownership notices;

  • Impersonate Belmont Watches;

  • Use our name or branding in a misleading manner; or

  • Create derivative commercial content from the Website.

21. Reviews, Comments, and Submissions

If you submit a review, photograph, comment, testimonial, message, or other content to Belmont Watches, you represent that you have the right to submit it and that it does not violate any law or third-party right.

You grant Belmont Watches a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and distribute that content for business, customer-service, marketing, and promotional purposes, subject to our Privacy Policy.

We may remove or decline to publish content that is unlawful, misleading, threatening, defamatory, infringing, fraudulent, obscene, abusive, or unrelated to the product or service being reviewed.

We are not obligated to compensate you for unsolicited ideas, suggestions, photographs, or other submissions.

22. Prohibited Uses

You may not use the Website:

  • For unlawful, fraudulent, deceptive, or abusive activity;

  • To purchase products using stolen or unauthorized payment information;

  • To interfere with Website security or functionality;

  • To transmit malware, harmful code, or automated attacks;

  • To collect another person’s information without authorization;

  • To violate intellectual-property or privacy rights;

  • To submit false ownership, identity, shipping, or payment information;

  • To evade sanctions, export controls, customs laws, or other legal restrictions; or

We may report suspected criminal or fraudulent activity to payment providers, shipping carriers, insurers, financial institutions, or law-enforcement authorities.

The Website may use or link to third-party platforms, including Shopify, payment processors, financing providers, shipping carriers, analytics providers, social-media platforms, and other service providers.

Belmont Watches does not control and is not responsible for the content, availability, security, privacy practices, policies, or performance of third-party services.

Your use of a third-party service may be governed by separate terms between you and that provider.

24. Privacy

Our collection, use, retention, and sharing of personal information are governed by the Belmont Watches Privacy Policy.

By using the Website, you acknowledge that online communications and transactions involve third-party networks and service providers and cannot be guaranteed to be completely secure.

25. Electronic Communications

By contacting us, placing an order, or providing an email address or telephone number, you consent to receive transaction-related electronic communications, including order confirmations, verification requests, invoices, shipping notices, return communications, and warranty updates.

Marketing emails may be sent when you have subscribed or otherwise consented. You may unsubscribe from marketing emails using the link provided in the message. Unsubscribing from marketing communications will not prevent us from sending necessary transaction or service communications.

26. Disclaimer of Warranties

EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY PROVIDED BY BELMONT WATCHES OR A MANUFACTURER, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE, ITS CONTENT, AND ALL PRODUCTS AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

BELMONT WATCHES DISCLAIMS ALL WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.

WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS. IN THOSE JURISDICTIONS, THIS SECTION APPLIES ONLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.

27. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BELMONT WATCHES AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOSS OF USE, LOSS OF VALUE, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE WEBSITE, A PRODUCT, A SERVICE, OR THESE TERMS.

TO THE FULLEST EXTENT PERMITTED BY LAW, BELMONT WATCHES’ TOTAL LIABILITY ARISING FROM A PRODUCT TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID TO BELMONT WATCHES FOR THE PRODUCT GIVING RISE TO THE CLAIM.

BELMONT WATCHES’ TOTAL LIABILITY ARISING SOLELY FROM USE OF THE WEBSITE, WHEN NO PRODUCT OR SERVICE WAS PURCHASED, WILL NOT EXCEED $100.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, gross negligence, personal injury, or nonwaivable consumer rights.

28. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Belmont Watches and its owners, employees, contractors, affiliates, and service providers from third-party claims, liabilities, damages, judgments, and reasonable expenses arising from:

  • Your unlawful or unauthorized use of the Website;

  • Your violation of these Terms;

  • Information or content you submit;

  • Your infringement of another person’s rights; or

  • A false representation made in connection with a sale, trade, consignment, or service transaction.

This section does not require a consumer to indemnify Belmont Watches for Belmont Watches’ own unlawful conduct.

29. Events Beyond Our Control

Belmont Watches is not responsible for delay or failure caused by events reasonably outside our control, including natural disasters, fire, flood, severe weather, labor disputes, carrier disruptions, customs actions, government orders, war, terrorism, civil unrest, power outages, internet outages, cyberattacks, supply-chain interruptions, or failure of third-party systems.

This section does not eliminate any refund, cancellation, or other consumer right required by law.

30. Informal Dispute Resolution

Before filing a lawsuit relating to these Terms or a transaction with Belmont Watches, you agree to contact us at info@belmontwatches.com and provide a written description of the dispute and the requested resolution.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after the written notice is received.

This section does not prevent either party from seeking immediate injunctive relief, filing an eligible small-claims action, meeting a legal filing deadline, reporting a matter to a government agency, or exercising a right that cannot lawfully be restricted.

31. Governing Law and Venue

These Terms and any dispute arising from them will be governed by the laws of the State of California, without regard to conflict-of-law rules.

Unless applicable law requires otherwise, any legal proceeding that is not resolved informally will be brought in a state or federal court located in San Diego County, California. You and Belmont Watches consent to the jurisdiction of those courts.

Nothing in this section deprives a consumer of protections provided by the mandatory laws of the consumer’s state or country of residence.

32. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

33. No Waiver

A failure by Belmont Watches to enforce a provision of these Terms does not waive our right to enforce that provision or any other provision later.

34. Assignment

You may not assign or transfer your rights or obligations under these Terms without our written consent.

Belmont Watches may assign these Terms in connection with a merger, acquisition, sale of assets, reorganization, or transfer of the business, subject to applicable law.

35. Entire Agreement and Order of Precedence

These Terms, together with the Privacy Policy, Refund Policy, Warranty Policy, applicable product listing, checkout disclosures, and any transaction-specific written agreement, constitute the agreement between you and Belmont Watches concerning your use of the Website and the applicable transaction.

If documents conflict, the following order generally applies:

  1. A signed transaction-specific agreement;

  2. Written product-specific or sale-specific terms;

  3. The applicable Refund Policy or Warranty Policy;

  4. These Terms.

36. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted on the Website with a revised “Last Updated” date.

Changes apply prospectively from the date they are posted unless applicable law requires additional notice or consent. The Terms in effect at the time of a completed purchase will generally govern that purchase.

Continued use of the Website after updated Terms become effective constitutes acceptance of the updated Terms.
